Terms & Conditions

Sizes given

The size given is the size that we will make the product to. We do not undertake to subtract or add any measurement given for tolerances. This also applies to the overall thickness, particularly when ordering sealed units. General advice can be given but not having seen the exact application it is up to the purchaser to make the decision. Miss measurements have to be paid for although we will be happy to cut down any annealed glass providing that there is enough to cut off we can’t add any glass on to make it bigger. Also bare in mind glass cannot be cut or processed by any one once it has been toughened

Advice

We are happy to give advice based on our years of experience; however the final decision must be with the purchaser

Marks on glass

We always strive to give the best possible to our customers. However on occasions there may be small imperfections in the glass caused in manufacture that are as an industry standard considered acceptable further details of this can be given on request

Tolerances in sizes

Due to the way glass is cut and processed there is an industry standard tolerance of + or- 2mm of the given sizes. Accuracy in sizes comes down to a measurement from a tape measure not a micrometre so it is not always possible to be absolutely spot on.

Measurements

Although we can accept both metric and imperial measurements metric is preferred. For clarity we always use millimetres. The industry standard is width then height when giving measurements

Possible effects to areas in and around areas we are working

Inside there is a possibility that the plaster work, wallpaper or tiles around the areas where we are working could be damaged, depending on the condition. Generally we will fill damaged plasterwork unless there is a major problem where it may be necessary for the purchaser to decide to have the plaster replaced at their own cost. If tiles are broken we can refit new ones providing there are spares available. Also shrubs and grass around the windows that we are working could get trodden down

Delivery times & conditions

Delivery times can vary for reasons beyond our control due to weather conditions, suppliers not turning up on time or incorrect products turning up. However we always strive to be as accurate as possible with our times given. Free delivery is available dependant on size of order and distance for supply only products. For free delivery items must be paid for and arrangements made to take delivery. Delivery is to site and not to specific rooms. Please note handling of glass and storage needs to be considered

Estimated fitting times

It is not possible to be accurate with fitting times as some jobs that appear identical to another can take a lot longer. This can be due to the way they are fixed or the amount of direct sunlight that is hitting it or a number of other factors

Alarms and Wiring

It is the responsibility of the householder to remove or isolate any wiring that runs through or next to any window or door frame as we cannot be held responsible for any repairs or inconvenience caused by damage to such wires. This includes door bells and TV Ariel wires

Access

We will need to access the area next to the windows. So consideration to trees and bushes need to be given as to whether you will need to cut them back. Also if there is a roof underneath the window that we cannot work off. This may need specialist roof ladders which will increase the price of the job

Guarantees

UPVC windows fitted by us have a manufacturer’s guarantee of 10 years. The handles, hinges, locks and other ironmongery have 12 month manufacturer’s guarantee. Sealed units fitted into UPVC windows and doors have a 10 year guarantee fitted into timber have a maximum of 5 years guarantee dependant on maintenance and condition of the frames. This can be agreed at the time of survey. Guarantees only apply when a product has been used as originally intended and no misuse has occurred for example: If someone swings on a door things will break which will not be covered by a guarantee. Also if a door is used when it needs to be serviced because it is excessively tight the mechanism will sooner or later break

The correct type of glass

There are laws concerning glazing that must be adhered to concerning safety glass. Glass comes in 3 forms: Annealed, Laminated and Toughened. Annealed glass is as it is made before any further processes are made. Laminated glass is 2 or more sheets of annealed glass bonded together with an interlayer of plastic giving a completely clear appearance. Toughened glass is a piece of annealed glass cut to size and then heated up to nearly melting point and then cooled. Note that once glass has been toughened it cannot be cut or altered in any way. There are 2 types of safety glass, laminated glass and toughened glass. When glazing doors (internal or external ) safety glass must be used in all cases unless the individual panes are less than 250mm wide where you can use 6mm float glass. This rule also applies to any window connected to a door or any glass that is below 800mm from the floor level on either side. This is not optional people have been prosecuted in the past when accidents have happened. If you are in any doubt as to what glass you need for a given application please ask as the responsibility is with the person who fits it.

Replacement parts

Manufacturers frequently cease to make exact replacement parts for windows and doors. So the 2 options are to either supply the closest match or to replace the whole window or door. The closest match option isn’t always as simple as it should be because in the case of door locks both the door leaf and the frame have cut outs made to accommodate the locks and keeps which are rarely in the same place with any other locks made. This means you have to make new cut outs which is difficult because doors are inherently reinforced with steel tubing.

Extras

When surveying windows and doors because we don’t actually remove the window we have to assume certain things that would normally be expected. If however these are not as assumed there will be extras above the original quotation. For instance if there are no lintels supporting the brickwork above the window one will need to be fitted by a builder appointed by either you or us. The point is if there is something out of the ordinary or unforeseen extra costs will be incurred which will be added to the original quotation. We will always keep you appraised of the situation as it occurs.

Colour matches

There are about 10 different shades of white that are available in upvc. products, some of which are less common and fewer products are supported which highlights the fact that we cannot always make an exact colour match. This once again leaves us with the scenario of the best match available, the decision is made on what we can get from our suppliers. Bearing in mind that certain things have been discontinued and also we do not always know the original manufacturer.

Rectification of faults or problems

When a fault is found with a product that we have supplied or fitted it must be reported to us immediately it is discovered so as not to make the situation worse. We will in turn arrange to look at the fault and make an evaluation as to who is responsible for paying for any rectification then we will discuss the best action to take.

Cracked glass

If a pane of glass is broken by us it will be replaced free of charge. However if it breaks sometime after installation it then becomes the responsibility of the customer. This can happen for a number of reasons for instance thermal shock caused by the glass heating or cooling rapidly can sometimes cause cracks to appear or impact from birds or animals. These things are however a rare occurrence

Payment

Payment is required for all Supply only materials on order unless prior arrangement is made. When works are undertaken a deposit of 50% will be required and the remainder will be paid on completion of the original agreed works ( amendments will be invoiced separately and paid for on their completion ) All goods remain the property of TMD Glass until full payment is made. Payment by credit card will incur a surcharge of 2.5% and we do not take American express.

Clarification

Designs of windows and doors must be agreed and signed off before an order is placed. A copy of this order will be countersigned by TMD Glass and given to the customer. Also clarification of all details must be made at the point of order whether it is for items that are supplied only or supplied and fitted. As much information that you can give us at this point will help to insure you get what you want.

Condensation

We cannot guarantee to cure problems with condensation. Condensation is moisture that builds up in a building that is given off by damp clothes, kettles, tumble dryers and even people breathing. This will collect on any cool surfaces notably your windows and surrounding walls. The two main things you can do to reduce this by having adequate ventilation to let the moisture out or to fit a de humidifier. We have more information on condensation on our web site.

Lintels

When surveying a building we assume that it has been built fitted with lintels over window and door apertures. Because windows and doors are not designed to take weight it is necessary to have them fitted if they are not present. This will be at the cost of the customer.

Door adjustment

Doors inherently get a lot of use and from time to time will need adjusting, just as your car will need servicing. When we fit doors sometimes they may need adjusting about a week later due to settling in, this we will do free of charge. It is advisable to have your doors serviced annually to extend its working life. This we can arrange for you at a reasonable charge

Repaired panes of glass

When a pane of glass is repaired to a timber window the decoration will need to be repainted or touched up to maintain the seal around the perimeter stopping water penetration. Similarly with puttied windows the putty will need to be painted within three weeks to stop it drying out and cracking. To keep the guarantee on timber windows the decoration needs to be done in accordance with the manufacturers recommendations, as a poorly decorated window will allow the double glazed units to break down

Alterations to these conditions

Any agreed alterations to these terms and conditions must be made in writing and signed by both parties. No verbal agreements or amendments will be accepted by either party. If you are unsure of the meaning of any part of this document please contact us for help.
